The 2018 Farm Bill made hemp legal as an agricultural commodity. It defines hemp as cannabis with a delta-9 tetrahydrocannabinol (THC) level of no more than 0.3% by dry weight. That definition determines which regulatory framework applies to your product. As a result, products that exceed the 0.3% THC threshold are not legally hemp at the federal level, regardless of how brands market them.

The FDA holds authority over hemp-derived cannabidiol (CBD) in food, beverages, and dietary supplements. Because of this, that authority shapes what brands can and cannot say on packaging. For example, health claims suggesting a product can treat, cure, or prevent a condition are not allowed under FDA rules. Keep packaging copy factual. Describe the product and its contents, and stop there.

Child-Resistance Requirements

Child-resistant (CR) packaging is not just for cannabis. Most state markets require CR packaging for ingested hemp products, such as edibles, tinctures, and capsules. The Consumer Product Safety Commission (CPSC) sets the federal standard under Code of Federal Regulations (CFR) Title 16, Part 1700.20. In practice, products sold through licensed retail channels need packaging tested and certified under that standard.
